The Supreme Court adjourned its decision so the case could be heard after Eid. This was the demand of the defence, so some other senior lawyers will be able to appear on Baba Jan behalf.

The case of fourteen activists facing two life sentences was to be reviewed. The life sentence of two of them is suspended. There will be more time to prepare for the defence of the twelve others.

Baba Jan is a political activist in Gilgit-Baltistan (GB) facing a life sentence along with 12 others in Gahkooch jail. He is a member of the Awami Workers’ Party federal committee and president of the Progressive Youth Front. He was sentenced on charges of rioting and organizing illegal rallies in 2010. His real “crime” was to help the victims of Atta Abad Lake to receive a fair compensation. The lake was established after the land slippage that blocked the path of the river.

In 2010, when the people of Ali Abad, the main city of Hunza valley, protested for fair compensation for all the genuine victims of the Atta Abad Lake, the police opened fire killing two protesters, a father and son. There was a very strong protest immediately and people rebelled. Baba Jan was not there at the time. He later joined the protest and tried to cool down the temperature of the mood of people by organizing rallies and demonstrations. It was promised that the police case would be registered against the responsible police office for firing on the peaceful demonstrators.

Instead, various police charges were registered against Baba Jan alongside over 100 activists from various political parties under anti-terrorist laws. Anti-terrorist laws are very often used against political activists in Pakistan and Gilgit-Baltistan on political grounds.

Baba Jan and his 12 colleagues were sentenced to life in 2014 by the anti-terrorist court, it had never been heard before that demonstrators should be sentenced to life for protesting. The High Court of GB acquitted Baba Jan later upon his appeal against the verdict.

Baba Jan stood in the general elections in 2015 and came second in his home constituency. However, when a bye election was to be held again in the same constituency, afterthe winner was made governor of GB, and it emerged that no one could match the popularity of Baba Jan, the government went to the Supreme Court and asked that their appeal against Baba Jan’s acquittal be heard before the election and the election should be postponed.

Later the Supreme Court restored the life sentence of Baba Jan, many believed the decision was taken on a political basis to keep Baba Jan out of the contest.

The Supreme Court should hear the final review petition of Baba Jan on 25th May 2017.

This is to demand from the government of GB to withdraw their appeal in the Supreme Court and plead at inthe Supreme Court for the release of Baba Jan and all others and to release all of them.

This is to demand the publication of the judicial commission report on the incident and implementation on the recommendations. The Judicial commission was established by the GB government to investigate the whole incident. The report was never published.

Un appel international aux gouvernements du Pakistan et du Gilgit-Baltistan
Un premier succès de la défense – La Cour suprême ajourne sa décision

Baba Jan, militant dévoué de Gilgit-Balistan, au nord du Pakistan, fait appel d’une double condamnation à perpétuité. Sa demande d’examen a été entendue par la Cour suprême le 25 mai 2017. Pour avoir un effet, cet appel international devait être envoyé le lundi 22, 2017. Beaucoup de signatures ont été reçues en seulement 48 heures, provenant de nombreux pays. L’appel a reçu un grand écho au Pakistan.

La Cour suprême a ajourné sa décision afin que l’affaire puisse être entendue après les fêtes de l’Eid. C’était ce que demandait la défense, afin que d’autres avocats de premier plan puissent comparaître pour le compte de Baba Jan.

Le cas de quatorze militants confrontés à deux condamnations à perpétuité devait être examiné. La condamnation à perpétuité de deux d’entre eux est suspendue. Il y aura plus de temps pour préparer la défense des douze autres. C’est un premier succès.

Baba Jan est un militant politique au Gilgit-Baltistan (GB) qui fait face à une peine d’emprisonnement à perpétuité avec 12 autres personnes dans la prison de Gahkooch. Il est membre du comité fédéral du Parti awami des Travailleurs et il est président du Front de la jeunesse progressiste. Il a été accusé d’avoir conduit des émeutes et organisé des rassemblements illégaux en 2010. Son véritable « crime » a en fait été de porter aide aux victimes du lac Atta Abad afin qu’elles reçoivent une indemnisation équitable. Le lac a été artificiellement créé par un glissement de terrain qui a bloqué le cours de la rivière.

En 2010, lorsque les habitants d’Ali Abad, la principale ville de la vallée de Hunza, ont protesté pour que toutes les victimes réelles du lac Atta Abadune reçoivent juste compensation, la police a ouvert le feu, tuant deux manifestants, un père et son fils. Il y a immédiatement eu une réaction de protestation très forte et la population s’est rebellée. Baba Jan n’était pas sur place à ce moment. Il a rejoint plus tard le mouvement en cours et a essayé de calmer un peu l’exaspération des gens en organisant des rassemblements et des manifestations. Les autorités ont promis qu’une enquête serait ouverte sur l’officier de police responsable d’avoir tiré sur des manifestants pacifiques.

Au lieu de cela, cependant, divers chefs d’accusation ont été portés à l’encontre de Baba Jan et de plus de cent activistes de divers partis politiques en vertu des lois antiterroristes. Les lois antiterroristes sont très souvent utilisées contre des militant(e)s au Pakistan et Gilgit-Baltistan pour des raisons politiques.

Baba Jan et ses douze collègues ont été condamnés à vie en 2014 par le tribunal antiterroriste – jamais auparavant des manifestants n’avaient été condamnés à vie pour le seul fait de protester ! Plus tard, la Cour suprême du Gilgit-Baltistan a acquitté Baba Jan après qu’il ait déposé un recours contre ce verdict.

Baba Jan s’est présenté aux élections générales de 2015. Il est arrivé deuxième dans sa circonscription. Cependant, lors d’une élection anticipée dans la même circonscription, organisée après que le précédent gagnant ait été nommé gouverneur du GB, il est apparu que personne ne pourrait égaler la popularité de Baba Jan. Le gouvernement s’est alors tourné vers la Cour suprême du Pakistan et a demandé que son recours contre l’acquittement de Baba Jan soit entendu avant l’élection – et que pour cela, les élections devaient être reportées.

Finalement, la Cour suprême a rétabli la condamnation à perpétuité de Baba Jan. Nombreux sont celles et ceux qui ont pensé que cette décision avait été prise sur une base politique afin d’empêcher Baba Jan de participer à l’élection.

La Cour suprême devrait une dernière fois entendre la requête de réexamen final de Baba Jan le 25 mai 2017.

Nous demandons au gouvernement du Gilgit-Baltistan de retirer son recours devant la Cour suprême et de plaider devant elle pour la libération de Baba Jan et tous les autres détenus, de les libérer tous.

Nous demandons la publication du rapport de la commission judiciaire sur l’incident et sur la mise en œuvre de ses recommandations. La commission judiciaire a été créée par le gouvernement GB pour enquêter sur l’ensemble de l’incident. Son rapport n’a jamais été publié.
